H The Jokers IKE διαθέτει χώρο στο σκληρό δίσκο διακομιστών (servers), οι οποίοι διανέμουν στο Internet το αποθηκευμένο σε αυτούς υλικό και την ηλεκτρονική αλληλογραφία των πελατών. Ο έτερος συμβαλλόμενος (πελάτης), προτίθεται να ενοικιάσει και να χρησιμοποιήσει τον προσφερόμενο από την The Jokers IKE εικονικό διακομιστή. Τα συμβαλλόμενα μέρη συμφωνούν και συναποδέχονται τα παρακάτω:
Υπηρεσίες
H The Jokers IKE διαθέτει προς χρήση στον πελάτη τον συμφωνημένο χώρο, και γνωστοποιεί στον πελάτη τους κωδικούς πρόσβασης και τα λοιπά τεχνικά στοιχεία με τους οποίους μπορεί να αποκτήσει πρόσβαση στις προσφερόμενες υπηρεσίες.
O πελάτης συμφωνεί ότι το υλικό που θα ανεβάζει στον server θα είναι έτοιμο και δεν θα χρειάζεται καμία επιπλέον επεξεργασία από την The Jokers IKE για να λειτουργήσει, ότι έχει τις απαραίτητες γνώσεις για να χρησιμοποιήσει τις υπηρεσίες της The Jokers IKE και ότι δεν είναι υπεύθυνη η The Jokers IKE να του προσδώσει αυτές τις γνώσεις.
O πελάτης αναγνωρίζει ότι το Internet δεν είναι ιδιοκτησία κανενός και δεν ελέγχεται από κανέναν, έτσι η The Jokers IKE δεν μπορεί να εγγυηθεί ότι οποιοσδήποτε χρήστης του Internet θα έχει πρόσβαση στον server οποιαδήποτε στιγμή. H The Jokers IKE θα κάνει κάθε δυνατή προσπάθεια ώστε ο server να είναι διαθέσιμος ευρύτατα και με όσο το δυνατόν λιγότερες διακοπές.
Η The Jokers IKE δεν φέρει καμία ευθύνη από την διαγραφή, μεταποίηση ή καταστροφή αρχείων που έχουν τοποθετηθεί στους servers της εταιρίας καθώς και για την διακοπή παροχής της υπηρεσίας λόγω ατυχημάτων. Σε περίπτωση ατυχήματος η The Jokers IKE οφείλει να καταβάλει τις μέγιστες προσπάθειες ώστε να επανέλθει η ομαλή λειτουργία του συστήματος και να συνεχιστεί η παροχή των υπηρεσιών προς τους χρήστες.
Ο πελάτης είναι υπεύθυνος για τυχόν βλάβες που προκαλούνται στο σύστημα από κακή χρήση του είτε με αυτοσκοπό την πρόκληση βλάβης, είτε τυχαία. Σε κάθε περίπτωση η The Jokers IKE διατηρεί το δικαίωμα να διεκδικήσει κάθε θετική και αποθετική ζημία που προέρχεται από πρόκληση βλάβης λόγω κακής χρήσης του συστήματος.
Περιεχόμενο
Απαγορεύεται ρητά η χρήση των υπηρεσιών της The Jokers IKE για οποιαδήποτε μη νόμιμο σκοπό περιλαμβανομένων αλλά μη περιοριζόμενων σε δημοσίευση πορνογραφικού περιεχομένου, πειρατικού περιεχομένου, αρχείων προερχομένων από κλοπή, αναδημοσίευση περιεχομένου χωρίς την απαραίτητη άδεια του εκδότη και την παραχώρηση πνευματικών δικαιωμάτων, αποστολή μαζικής αλληλογραφίας χωρίς την έγκριση των παραληπτών και την αναφορά της ταυτότητας του αποστολέα. Κάθε χρήστης που χρησιμοποιεί (ή προτρέπει τους επισκέπτες των σελίδων του μέσω links) σε σελίδες με περιεχόμενο ή πρακτικές που εμπίπτουν στα παραπάνω, μπορεί να οδηγηθεί σε άμεση διακοπή της συνεργασίας με την The Jokers IKE, η οποία μπορεί και να δικαιώσει κάθε θετική και αποθετική ζημία από τη μη σωστή χρήση των υπηρεσιών της.
Πιο αναλυτικά οι χρήστες των υπηρεσιών της The Jokers IKE απαγορεύεται ρητά να χρησιμοποιούν τους web servers της εταιρίας για δημοσίευση περιεχομένου:
Αντίθετου στην ισχύουσα νομοθεσία (π.χ. υβριστικό, που προσβάλει την δημόσια αιδώ, που παραβιάζει πνευματικά δικαιώματα (copyright), είναι ανάρμοστο για άτομα ηλικίας κάτω των 18 ετών κ.λπ.).
Πορνογραφικού, ρατσιστικού και γενικά ανήθικου σύμφωνα με τα ήθη της Ελληνικής κοινωνίας αλλά και της κοινότητας του Internet περιεχομένου (π.χ. serial ή registration numbers από εμπορικά προγράμματα, cracker utilities, συμβουλές για spamming κ.λπ.).
Παραπομπών σε χώρους με υλικό που απαγορεύεται η τοποθέτησή του στην The Jokers IKE.
Σελίδες οποιουδήποτε περιεχομένου αν αυτές έχουν διαφημιστεί με ανάρμοστο τρόπο μέσα στο Internet (spamming κ.λπ.)
Αποκλειστικός κριτής του αν και κατά πόσον οι σελίδες που τοποθέτησε χρήστης εμπίπτουν σε μια από τις παραπάνω κατηγορίες είναι μόνον η The Jokers IKE που έχει το δικαίωμα να διαγράφει χωρίς προηγούμενη προειδοποίηση, αν το θεωρήσει αναγκαίο, λογαριασμούς χρηστών που παραβιάζουν τους παραπάνω όρους.
Η The Jokers IKE δεν ευθύνεται για το περιεχόμενο των λογαριασμών των χρηστών της και δεν εγγυάται για την ακρίβεια των πληροφοριών που παρέχονται από αυτές.
Ο πελάτης συμφωνεί ότι προτίθεται να κάνει λογική χρήση του email του και ότι η μέση κίνηση των email που διακινεί μέσω του server είναι μέσα στα πλαίσια της φυσιολογικής κίνησης ενός μέσου χρήστη του Internet.
Απαγορεύονται αυστηρά και αποτελούν λόγο άμεσου τερματισμού του account τα παρακάτω:
Αποστολή μηνυμάτων μαζική ή μη, σε παραλήπτες που δεν έχουν ζητήσει την παραλαβή των μηνυμάτων (spamming).
Εγγραφή σε mailing list κάποιου παραλήπτη χωρίς την έγκριση του.
Διαφήμιση υπηρεσιών και προϊόντων sites που φιλοξενούνται σε server της The Jokers IKE μέσω spamming κατά οποιοδήποτε έμμεσο ή άμεσο τρόπο, ακόμη και αν η αποστολή των μηνυμάτων έγινε εκτός των server της The Jokers IKE.
Σε αποδεδειγμένη διαμαρτυρία για spamming, το account από το οποίο προκλήθηκε η αποστολή των μηνυμάτων τίθεται άμεσα σε κατάσταση αναστολής λειτουργίας (suspended) μέχρι να διερευνηθεί το συμβάν, και καλείται ο πελάτης να δώσει εξηγήσεις. Σε περίπτωση που δεν δοθούν ικανοποιητικές εξηγήσεις εντός 24 ωρών το account διαγράφεται χωρίς άλλη προειδοποίηση.
Χρήση πόρων
Ο πελάτης συμφωνεί ότι προτίθεται να κάνει λογική χρήση των πόρων του server που φιλοξενείται, ότι δεν προορίζονται όλοι οι πόροι του server για δική του χρήση και αναγνωρίζει ότι μοιράζεται τους πόρους του server με άλλους χρήστες.
Ως όριο στη χρήση της υπολογιστικής ισχύος (CPU) και μνήμης του server τίθεται το 10% των συνολικών πόρων του server. Σε περίπτωση που οι διεργασίες που εκτελούνται στο account του πελάτη ξεπερνούν σε σταθερή βάση την κατανάλωση του 10% των συνολικών πόρων του server, ο πελάτης ενημερώνεται σχετικά ώστε να τερματίσει τις συγκεκριμένες διεργασίες. Αν μετά την ενημέρωση το account του πελάτη συνεχίζει και παρουσιάζει αυξημένη κατανάλωση των συνολικών πόρων του server τότε η The Jokers IKE διατηρεί το δικαίωμα να τερματίσει τις διεργασίες χωρίς άλλη σχετική ενημέρωση του πελάτη.
Οι διαθέσιμοι πόροι του server προορίζονται αποκλειστικά για χρήση εντός των account των πελατών της The Jokers IKE. Απαγορεύεται η διάθεση πόρων κατά οποιονδήποτε τρόπο σε sites τρίτων με οποιαδήποτε μορφή, περιλαμβανομένων αλλά μη περιοριζόμενων σε άντληση γραφικών ή κειμένων από sites τρίτων υλικού που βρίσκεται σε server της The Jokers IKE, εκτέλεση προγραμμάτων banner exchange κ.λπ.
Ο πελάτης οφείλει να επιβλέπει το μέγεθος του χώρου που καταλαμβάνει αυτός και οι υπόλοιποι χρήστες του account του στους σκληρούς δίσκους της The Jokers IKE, ώστε αυτό να μην υπερβαίνει τα όρια που έχουν οριστεί. Σε περίπτωση που ο χώρος που καταλαμβάνεται ξεπεράσει τα όρια, η The Jokers IKE διατηρεί το δικαίωμα να διαγράψει αρχεία ώστε να επανέλθει ο χρησιμοποιούμενος χώρος στα επιτρεπτά όρια.
Σε περίπτωση που η χρήση πόρων όπως αυτού της μέγιστης μηνιαίας διακίνησης δεδομένων ξεπεράσει τα όρια που περιλαμβάνονται στο account του πελάτη, η The Jokers IKE διατηρεί το δικαίωμα να αφαιρέσει το κόστος της επιπλέον κατανάλωσης από το υπόλοιπο του λογαριασμού φιλοξενίας του πελάτη αναπροσαρμόζοντας την ημερομηνία λήξης του account του.
Επικοινωνία
Ο πελάτης οφείλει να έχει πάντα τα στοιχεία επικοινωνίας του ενημερωμένα, και να ειδοποιεί την The Jokers IKE για κάθε μεταβολή τους. Οφείλει δε να ορίσει μία email διεύθυνση εκτός των email διευθύνσεων των domains του που φιλοξενούνται στην The Jokers IKE σαν κύρια email διεύθυνση επικοινωνίας, ώστε να μπορεί η The Jokers IKE να επικοινωνήσει μαζί του ακόμη και σε περίπτωση που παρουσιαστεί κάποιο πρόβλημα στο account του.
H επικοινωνία και ενημέρωση της The Jokers IKE προς τον πελάτη για θέματα που αφορούν στο account του (αναβαθμίσεις στους servers, λήξη – ανανέωση account κτλ ) διεξάγεται μέσω e-mail. Ο πελάτης οφείλει να ελέγχει τακτικά το email που έχει ορίσει σαν κύριο email επικοινωνίας ώστε να ενημερώνεται για θέματα που αφορούν το account του.
Ενεργοποίηση – Ανανέωση
Η ενεργοποίηση του account του πελάτη γίνεται μετά την καταβολή του τιμήματος της συνδρομής φιλοξενίας.
Η ανανέωση του λογαριασμού φιλοξενίας γίνεται αυτόματα κατά την λήξη της συνδρομής και για το ίδιο χρονικό διάστημα με αυτό της αρχικής συνδρομής με προϋπόθεση ότι θα έχει καταβληθεί το αντίτιμο της ανανέωσης της συνδρομής μέχρι την ημερομηνία λήξης της συνδρομής. Η The Jokers IKE οφείλει να υπενθυμίσει στον πελάτη την λήξη της συνδρομής μέσω email 15 ημερολογιακές ημέρες πριν, και να τον ενημερώσει για τις εναλλακτικές μεθόδους πληρωμής του αντιτίμου ανανέωσης της συνδρομής του. Σε περίπτωση μη εμπρόθεσμης καταβολής του αντιτίμου ανανέωσης, την επομένη της λήξης της συνδρομής το account του πελάτη τίθεται σε κατάσταση αναστολής λειτουργίας για 30 ημέρες, ενώ παράλληλα αποστέλλεται και νέα ειδοποίηση. Αν εντός των ημερών αυτών δεν καταβληθεί το αντίτιμο της ανανέωσης της συνδρομής ή δεν υπάρξει επικοινωνία από την πλευρά του πελάτη και διευθέτηση του ζητήματος, το account διαγράφεται οριστικά.
Σε περίπτωση πληρωμής μέσω πιστωτικής κάρτας, ο πελάτης πρέπει σύμφωνα με τις οδηγίες που θα του δοθούν να προβεί σε νέα χρέωση της πιστωτικής του κάρτας. H The Jokers IKE δεν ανανεώνει αυτόματα τις συνδρομές μέσω πιστωτικών καρτών με επαναχρέωση της πιστωτικής κάρτας. Οποιαδήποτε πληρωμή προς την The Jokers IKE γίνεται μέσω πιστωτικής κάρτας αφορά μία και μοναδική χρέωση.
Διακοπή συμφωνητικού
Το παρόν συμφωνητικό μπορεί να διακοπεί από οποιονδήποτε των συμβαλλομένων χωρίς αιτία, αν και όποτε γίνει αυτό από την πλευρά της The Jokers IKE τότε η The Jokers IKE θα επιστρέψει το συμφωνημένο ποσό για το χρονικό διάστημα που απομένει από την ημέρα της διακοπής έως την κανονική λήξη της σύμβασης. Η The Jokers IKE δεν υποχρεούται σε επιστροφή του συμφωνημένου ποσού για το χρονικό διάστημα που απομένει από την ημέρα της διακοπής έως την κανονική λήξη της σύμβασης σε περίπτωση επανειλημμένων παραβάσεων των όρων χρήσης από τον πελάτη. H The Jokers IKE διατηρεί το δικαίωμα προς τους πελάτες της να αρνηθεί, τερματίσει ή να θέσει σε διαθεσιμότητα τις υπηρεσίες της κατά βούληση αν κρίνει ότι γίνεται κατάχρηση αυτών και δεν θα είναι υπεύθυνη για επιπτώσεις, θετικές και αρνητικές, που μπορεί να προκύψουν λόγω του τερματισμού ενός λογαριασμού.
Εξασφάλιση
Ο πελάτης συμφωνεί ότι θα υπερασπιστεί έναντι παντός δικαστηρίου, θα εξασφαλίσει, θα κρατήσει μακριά από κάθε κίνδυνο, από όλες τις απαιτήσεις, απώλειες, χρηματικές διεκδικήσεις και ευθύνες την The Jokers IKE και θα την καλύψει από κάθε χρηματικό κόστος συμπεριλαμβανομένων και των αμοιβών των δικηγόρων, από οποιαδήποτε υπόθεση ή διεκδίκηση λόγω ζημίας ή βλάβης ή οποιασδήποτε άλλης αιτίας εγείρει οποιοσδήποτε τρίτος εναντίον της The Jokers IKE εξαιτίας των δραστηριοτήτων και υπηρεσιών ή άλλων πράξεων του πελάτη ή περιεχομένων και πληροφοριών που κινήθηκαν μέσω του λογαριασμού φιλοξενίας του.
Δήλωση εχεμύθειας
Η The Jokers IKE δεσμεύεται ότι δεν θα γνωστοποιήσει ή πουλήσει το email ή άλλα προσωπικά δεδομένα του πελάτη σε οποιοδήποτε τρίτο. Η The Jokers IKE θα γνωστοποιήσει τα περιεχόμενα των emails και της ηλεκτρονικής επικοινωνίας των πελατών της μόνο σε περίπτωση που υπάρξει σχετικό αίτημα από τις Ελληνικές αρχές για διαλεύκανση υποθέσεων παραβίασης της νομοθεσίας. Σε αυτήν την περίπτωση η The Jokers IKE θα συνεργαστεί πλήρως με τις αρχές και θα παράσχει κάθε είδους διευκόλυνση για την αποκάλυψη παράνομων δραστηριοτήτων.
Εγγύηση
Tα πακέτα φιλοξενίας εικονικών διακομιστών της The Jokers IKE συνοδεύονται από εγγύηση επιστροφής χρημάτων 30 ημερών από την ημερομηνία έναρξης του λογαριασμού φιλοξενίας. Αν ο πελάτης δεν μείνει ικανοποιημένος από το επίπεδο υπηρεσιών της The Jokers IKE, μπορεί μέσα σε 30 ημέρες από την έναρξη του λογαριασμού του να ζητήσει την ακύρωση του παρόντος συμφωνητικού. Στην περίπτωση αυτή επιστρέφεται στον πελάτη το συνολικό πόσο της συνδρομής του.
Σε περίπτωση που το πόσο της συνδρομής περιλάμβανε πρόσθετα έξοδα (αγορά domain name, προμήθειες τρίτων ή προμήθειες τραπεζών ή πιστωτικών καρτών, έξοδα εγκατάστασης, πρόσθετες υπηρεσίες) το ποσό της συνδρομής επιστρέφεται στον πελάτη αφού παρακρατηθούν τα παραπάνω έξοδα. Καμία επιστροφή χρημάτων δεν γίνεται μετά την 30η μέρα της συνδρομής. Η παραπάνω εγγύηση αφορά αποκλειστικά και μόνο τα πακέτα ενοικίασης εικονικών διακομιστών, και όχι το σύνολο των παρεχομένων υπηρεσιών της The Jokers IKE.
Aποδοχή όρων χρήσης
Η τοποθέτηση σελίδων και πληροφοριών και γενικότερα η χρήση του δικτύου της The Jokers IKE συνεπάγεται αυτόματη και ανεπιφύλακτη αποδοχή των παραπάνω όρων. Η The Jokers IKE διατηρεί το δικαίωμα να μεταβάλει κατά βούληση και χωρίς άλλη προειδοποίηση πλην της ανακοινώσεως στον χώρο αυτό των κανόνων που αφορούν το περιεχόμενο των σελίδων των χρηστών της και είναι στην ευθύνη του πελάτη να φροντίζει να ενημερώνεται σχετικά από την παρούσα ιστοσελίδα.
ENGLISH VERSION
The Jokers IKE has space on the hard disk of servers, which distribute on the Internet the material stored in them and the electronic mail of the customers. The other party (client) intends to rent and use the virtual server offered by The Jokers IKE. The parties agree and agree to the following: Services The Jokers IKE makes the agreed space available to the customer for use, and informs the customer of the access codes and other technical data with which he can gain access to the services offered. The customer agrees that the material he will upload to the server will be ready and will not need any additional processing by The Jokers IKE to work, that he has the necessary knowledge to use the services of The Jokers IKE and that he is not responsible The Jokers IKE to impart this knowledge to him. The customer acknowledges that the Internet is not owned by anyone and is not controlled by anyone, so The Jokers IKE cannot guarantee that any Internet user will have access to the server at any time. The Jokers IKE will make every effort to ensure that the server is widely available and with as few interruptions as possible. The Jokers IKE bears no responsibility for the deletion, modification or destruction of files placed on the company’s servers as well as for the interruption of the service due to accidents. In the event of an accident, The Jokers IKE must make every effort to restore the smooth operation of the system and continue providing services to users. The customer is responsible for any damage caused to the system by its misuse, either intentionally or accidentally. In any case, The Jokers IKE reserves the right to claim any positive and consequential damages arising from damage caused by misuse of the system. Content It is expressly prohibited to use the services of The Jokers IKE for any illegal purpose including but not limited to posting pornographic content, pirated content, stolen files, republishing content without the necessary permission of the publisher and assigning copyright, sending mass mail without the approval of the recipients and the reporting of the identity of the sender. Any user who uses (or prompts the visitors of his pages through links) to pages with content or practices that fall under the above, may be led to an immediate termination of cooperation with The Jokers IKE, which may justify any positive and negative damage from improper use of its services. In more detail, users of The Jokers IKE services are expressly prohibited from using the company’s web servers to publish content: Contrary to applicable law (e.g. abusive, defamatory, infringing copyright, inappropriate for persons under 18 years of age, etc.). Pornographic, racist and generally immoral content according to the morals of Greek society and the Internet community (e.g. serial or registration numbers from commercial programs, cracker utilities, spamming tips, etc.). References to sites with material that is prohibited from being placed on The Jokers IKE. Pages of any content if they have been inappropriately advertised on the Internet (spamming, etc.) The sole judge of whether and to what extent the pages posted by a user fall into one of the above categories is only The Jokers IKE, which has the right to delete without prior warning, if it deems it necessary, user accounts that violate the above terms. The Jokers IKE is not responsible for the content of its users’ accounts and does not guarantee the accuracy of the information provided by them. E-mail The customer agrees that he intends to make reasonable use of his e-mail and that the average e-mail traffic through the server is within the limits of the normal traffic of an average Internet user. The following are strictly prohibited and are grounds for immediate account termination: Sending messages in bulk or not, to recipients who have not requested the receipt of the messages (spamming). Signing up to a recipient’s mailing list without their approval. Advertising of services and products sites hosted on The Jokers IKE servers through spamming in any indirect or direct way, even if the messages were sent outside of The Jokers IKE servers. In a proven spam complaint, the account from which the messages were sent is immediately suspended until the incident is investigated, and thefir to give explanations. If satisfactory explanations are not given within 24 hours, the account will be deleted without further warning. Resource usage Customer agrees that it intends to make reasonable use of the hosted server resources, that not all server resources are intended for its own use, and acknowledges that it shares server resources with other users. 10% of the server’s total resources is set as a limit to the use of the server’s computing power (CPU) and memory. In the event that the processes performed on the client’s account consistently exceed the consumption of 10% of the server’s total resources, the client is informed accordingly in order to terminate the specific processes. If, after the update, the customer’s account continues and shows an increased consumption of the total server resources, then The Jokers IKE reserves the right to terminate the processes without further informing the customer. The available server resources are intended exclusively for use within the accounts of The Jokers IKE customers. It is prohibited to make resources available in any way to third party sites in any form, including but not limited to extracting graphics or texts from third party sites, material located on The Jokers IKE server, running banner exchange programs, etc. The customer must supervise the size of the space occupied by him and the other users of his account on the hard drives of The Jokers IKE, so that it does not exceed the limits that have been set. In the event that the space occupied exceeds the limits, The Jokers IKE reserves the right to delete files in order to bring the space used back within the allowable limits. In the event that the use of resources such as the maximum monthly data traffic exceeds the limits included in the customer’s account, The Jokers IKE reserves the right to deduct the cost of the additional consumption from the balance of the customer’s hosting account by adjusting the expiration date his account. Contact The customer must always keep his contact information up to date, and notify The Jokers IKE of any change. He must also set an email address other than the email addresses of his domains hosted at The Jokers IKE as the main contact email address, so that The Jokers IKE can contact him even in the event of a problem with his account. The communication and information of The Jokers IKE to the customer about matters concerning his account (upgrades to the servers, expiration – renewal of the account, etc.) is carried out via e-mail. The customer must regularly check the email he has designated as the main communication email in order to be informed of issues concerning his account. Activation – Refresh The customer’s account is activated after payment of the hosting subscription. The renewal of the hosting account is done automatically at the end of the subscription and for the same period of time as that of the initial subscription, provided that the price of the renewal of the subscription has been paid by the date of expiry of the subscription. The Jokers IKE must remind the customer of the expiration of the subscription by email 15 calendar days before, and inform him of the alternative payment methods of his subscription renewal fee. In case of late payment of the renewal fee, the day after the end of the subscription, the customer’s account is suspended for 30 days, while at the same time a new notification is sent. If within these days the price of the renewal of the subscription is not paid or there is no communication from the customer’s side and settlement of the issue, the account is permanently deleted. In case of payment by credit card, the customer must, according to the instructions given to him, make a new charge to his credit card. The Jokers IKE does not automatically renew credit card subscriptions with a credit card charge. Any payment to The Jokers IKE made by credit card is a single charge. Termination of contract This agreement may be terminated by either party without cause, although whenever this is done by The Jokers IKE then The Jokers IKE will refund the agreed amount for the period remaining from the day of termination until the normal expiration of the contract. The Jokers IKE is not obliged to refund the agreed amount for the period of time remaining from the day of interruption to the normal termination of the contract in case of repeated violations of the terms of use by the customer. The Jokers IKE reserves the right to its customers to refuse, terminate or suspend its services at will ifthat they are misused and will not be responsible for any effects, positive or negative, that may arise due to the termination of an account.
